1. Using Market Rotay

These Terms govern your access to Market Rotay, operated by Jefferson Thomas Raffensperger ("Market Rotay," "we," or "us"). By using the site, you agree to these Terms. If you do not agree, do not use the site. These Terms cover the charts, scores, research explanations and market data displayed through Market Rotay, including historical and preview features.

2. Permitted research use

Subject to these Terms, you may access the features we make available for your own personal research or internal business research. This permission is limited, non-exclusive, non-transferable and non-sublicensable. It does not include redistribution, commercial exploitation of the data, or access to Tiingo's services or credentials. Ordinary viewing does not give you ownership of the data or a right to extract it. Any permitted export is subject to the stricter personal-research-only limits below.

3. No bulk exports or redistribution

You must not bulk download, scrape, harvest, systematically collect, or redistribute market data from Market Rotay. Do not combine repeated small requests, accounts, sessions or downloads to reconstruct a feed, price history collection or database. You must not sell, resell, rent, sublicense, republish, distribute, or provide third-party access to Tiingo data, whether free or paid. You may not operate a data service, service bureau, mirror, feed or API using that data.

No raw or machine-readable market-data export is authorized by these Terms, including CSV, Excel, JSON, API access or other raw-data downloads. If Market Rotay expressly enables and identifies a limited export as permitted under its applicable data license, that permission is confined to one or a few tickers and the stated limits. Any such exported data may be used only for your own personal research purposes, not business use, resale, redistribution or sublicensing. Repeated limited exports may not be combined into bulk access. The technical availability of a file or response does not grant export rights. A feedback-note download is not permission to export market data.

4. Data and service restrictions

Except for uses expressly permitted through Market Rotay and allowed by its applicable data license, you must not copy, modify, adapt, translate or create derivative works from Tiingo data or services. You must not reverse engineer, decompile, disassemble or attempt to discover underlying source code, algorithms, file formats or interface protocols of Tiingo services or data; reconstruct underlying data from charts, scores or explanations; or create a substitute for the licensed data. These restrictions apply to the extent permitted by applicable law.

Do not remove or alter attribution, copyright notices, proprietary markings or restrictive legends. Do not disclose restricted data to third parties, bypass access controls or usage limits, share access to restricted services, attempt unauthorized access, disrupt service integrity or performance, or use the data unlawfully. Do not use Tiingo data or services for benchmarking or competitive analysis of Tiingo's services or data, publish such service/data analyses, or build a competing data product or service. This does not prohibit the ordinary market research expressly permitted above.

You must not use Tiingo data to train or fine-tune an AI or machine-learning model, or upload or redistribute it to third-party AI tools. Research explanations available within Market Rotay do not authorize external data feeds, model training, or extraction of the underlying data.

5. Ownership and attribution

Market Rotay and its licensors retain their respective rights in the site and content. Tiingo retains its rights in its services, documentation and related intellectual property; market-data rights remain with their respective owners. No ownership or other license is transferred except the limited permission expressly stated here.

Market Data from Tiingo.com

Tiingo attribution identifies the market-data source. It does not imply that Tiingo endorses Market Rotay's scores, methods, selections or conclusions. Additional upstream-source restrictions may apply to particular data; access to a feature does not expand the permissions stated in these Terms.

6. Research and market-data disclaimer

Market Rotay provides information and education, not personalized investment, legal or tax advice, a recommendation to buy, sell or hold a security, or an offer to transact. Scores, labels, charts and explanations describe research observations and do not account for your circumstances. A high score is not a forecast or a guarantee of profit. You are responsible for your decisions and for independently verifying information with appropriate sources before acting.

All investments involve risk, including loss of principal. Past performance does not guarantee future results. Historical examples and backtests are hypothetical, not actual investment results. Selected universes, revised or adjusted data, hindsight, overlapping observations and omitted costs or taxes may affect results. Ratios describe relative performance; both assets can decline.

Market data and research may be delayed, stale, incomplete, inaccurate, revised or unavailable. Historical previews are not live feeds. Check the displayed data date and methodology. No promise is made that every error will be corrected, that coverage is complete, or that service will be uninterrupted. Verify prices with your broker or another appropriate source before trading.

7. Availability, warranties and liability

To the extent permitted by applicable law, Market Rotay and its data providers, including Tiingo and upstream sources, provide the site, data and research "as is" and "as available," without warranties of accuracy, completeness, timeliness, uninterrupted or error-free operation, merchantability or fitness for a particular purpose. To the extent permitted by applicable law, they are not liable for indirect, consequential, punitive or exemplary losses arising from use of or inability to use the site or data, including lost profits or revenues. Nothing in these Terms excludes a warranty, liability or consumer right that cannot lawfully be excluded or limited.

8. Suspension and data deletion

We may restrict or suspend access for misuse, breach of these Terms, security concerns, or data-provider requirements, and may discontinue features or data when the necessary rights are unavailable. You must stop unauthorized use immediately. If we notify you that rights to use Tiingo data have ended, you must stop using it and delete or destroy all retained Tiingo data, including any permitted exports, from your systems and records, and confirm completion if requested. A retained research output is not exempt merely because it is called a chart or report. Any exception must be expressly confirmed by Market Rotay under its applicable license. Restrictions on retained data and ownership provisions continue after access ends.

9. Updates to these Terms

We may update these Terms by posting a revised version and revision date. Where required by applicable law, we will provide additional notice or obtain agreement before a change takes effect. If you disagree with revised Terms, stop using the affected service. These Terms do not grant rights beyond the permissions Market Rotay can lawfully provide.
